Terms of Service

Introduction

  • These Terms of Service ("Terms") form a legally binding agreement between you ("Customer", "User") and AceRDP LLC ("AceRDP", "we", "us", "our"), a United States registered Limited Liability Company.
  • By accessing, purchasing, or using our RDP, VPS, or related hosting services ("Services"), you agree to be bound by these Terms.
  • If you do not agree with any part of these Terms, you must not use our Services.

Service Description

  • AceRDP provides virtualized remote desktop and server hosting solutions utilizing allocated compute, RAM, storage, and bandwidth resources as displayed at the time of purchase.
  • Services are delivered digitally and provisioned upon successful payment confirmation.
  • We may modify, upgrade, or reconfigure infrastructure (hardware, network, virtualization stack, locations) to maintain service performance, stability, and security.

Billing & Payments

  • All services must be paid in full prior to activation, renewal, or reactivation.
  • Payments may be processed via authorized third-party payment processors.
  • If a service expires due to non-payment, it may be suspended immediately and later deleted. Recovery is not guaranteed.

Refund Policy

  • All payments are final and non-refundable unless required by law.
  • Any credits, partial refunds, or service extensions are provided solely at AceRDP’s discretion.

Chargebacks & Payment Disputes

  • Filing a chargeback or payment dispute without first contacting support may result in immediate suspension or termination of services.
  • We may provide relevant account, service, and transaction records to payment processors and dispute resolution systems to respond to claims.

User Responsibilities

  • Users must comply with all applicable laws and regulations.
  • Users are responsible for securing their login credentials and access methods.
  • Users are solely responsible for maintaining independent backups. AceRDP is not responsible for data loss.

Prohibited Activities

  • Distributed Denial-of-Service (DDoS) attacks or stress testing.
  • Spam, bulk messaging, or unsolicited email campaigns.
  • Botnets, malware, credential theft, or unauthorized access attempts.
  • Cryptocurrency mining or sustained resource abuse impacting infrastructure.
  • Port scanning, vulnerability scanning, or reconnaissance without explicit authorization.

Suspension & Termination

  • We reserve the right to suspend or terminate services immediately (with or without notice) if violations occur, if activity threatens network reputation, or if required by law.
  • No refunds are issued for suspended or terminated services due to violations or abuse.
  • We may permanently remove content, snapshots, or servers involved in prohibited activities.

Limitation of Liability

  • To the maximum extent permitted by law, AceRDP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or business interruption.
  • Our total liability for any claim related to the Services shall not exceed the amount paid by you for the affected service during the thirty (30) days preceding the event giving rise to the claim.

Uptime & Service Credits

  • We target 99.9% uptime. Planned maintenance, upstream outages, abuse mitigation, and force-majeure events may impact availability.
  • Compensation, if any, is provided as service credit or additional service time at AceRDP’s discretion.

Changes to the Terms

  • We may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
